I have a copyright case in Pixsy open against this business, but it was just closed because they could not contact the owners.

I was trying to determine if this place is still in business and I was wondering if anyone here lived in the area and could confirm if they are still in business?

Looking at the reservation form on their website, it seems like they may be out of business indeed, though my pic is still up there.

I only see a very tiny little picture of a lighthouse... not a big deal I think. Are they earning money using this picture?

It's commercial use of my photo so it doesn't matter whether they are making money from it. The copyright agency only goes after commercial use, and the case was accepted.

Yes, I had tried that before posting...the whole website has problems. The question then simply becomes are they still in business. That's why I went to Google Maps/Streetview. But the streetview is from 2012. Just figured there may be a DPCer that lives right near there (I wouldn't want anyone to go out of their way to find it, but if they lived nearby...)

if you google "Sandpiper Cottages Hours" they appear to still be open as google would say "closed permanently" if they are out of business.

Good idea. I didn't do that because I had the URL and even the phone.

Google thinks it's still open, but this article it also showed me indicates that it closed in August, but was purchased for 1 million and is being replaced with luxury cottages:

We'll see if THEY stop using my image, otherwise, I'll be back on them.

Looking at the thread and status of business, how did you come to know about your image being used by them?

I use Pixsy, pixsy.com. Join, submit some images, their software searches (similar to Google Image Search), and then you submit cases (commercial use only). They pursue it and take a cut.

Yeah, but the misappropriation is by the people that SOLD the business, not the fat-cat developers that are tearing down the cottages and going upscale. They'll certainly trash that web site and build a better one. Of course, they might want the image regardless, but who knows?

Once you're done suing them, someone should go after whoever built that crap-tastic website.

If you find out who their hosting site is and submit a copyright infringement with them, they will take the whole site down if the owners don't respond in a short time. Usually you will find the contact information on the Whois.sc web site if you plug in the domain name.

I've done this a couple of times and the host sites took down the offending site really quick. If the image is registered, be sure and add that to the complaint to the hosting site, it seems to help them move a little quicker.
