actually I'd spin it that the background people are intruding into my personal privacy by inserting themselves into my photographs or selfies...

i'll call it the photobombing precedent.

i think what the law means is if you are purposefully taking pictures of people without their knowledge or consent, where they are the main subject for the setting.
people in the background are inconsequential and nobody can have any right to be up in arms that "i was in a prominent location and happen to be caught on camera, out of focus or not, as i walked past an open public area".
even the police cannot force you to delete images of them in uniform in public (well, unless they overpower you and do it, which is a very different story *cough*rodney king*cough*.

So street photography will be "illegal" and street photographers are SOL...?

I can so easily see a new source for frivolous lawsuits: anyone observing someone carefully framing their shot in a public place so as not to include "background" strangers - and then photobombing them. Then suing them for having them in the bg.

You just have to make sure all your scenes are completely empty. All Philippines photos must be... unphilled.

You have to scare off all the annoying people cluttering up your scenes. Just say, "Boo!" ta' pests.

Actually some of the people I know in the Philippines believe that this is mostly an attempt by the government to crack down on citizen journalists who may document things the government there doesn't want made public...what better way to go about that than rounding them all up and putting them in jail.

That's a pretty sinister tactic, but given that the article posted doesn't seem to give a basis for the change in law, I'm inclined to believe it is something close to what Spork's reporting.
