update, I have now won my case, but because they backed out of the lawsuit, the judge couldn't invalidate the ridiculous patent.
So you are all now on your own to fight if it happens to you or any website you are on.
If someone could post the link, it's still not allowing me to post :(
btw, no one is infringing, its a junk patent and was only created so they could go after everyone on the internet to extort money.
They submitted the stupid patent in 2007 and our lovely patent office made the HUGE mistake of approving it.
It does no more than any website that has been running since the internet began.

another update :) we were awarded attorney fees. Not 100%, but at least from April
I think the judge wondered why I didn't just take Garfum's offer to end the lawsuit, but then he realized my goal was to invalidate the patent.
So, even though the case was over, the judge took it upon himself to invalidate the patent for us :)
Horrah!! no one can ever be hurt by this ridiculous patent again.

That's a great victory, for common sense! It's about time some patent trolls were forced back under the bridge. |
