It was a preliminary hearing - never got to a full case because the Shetland News won the point at an initial stage (as I recall, obtained an injunction pre-trial), on the basis of which their opposition determined that it was unlikely that they would win the full trial and settled.

Deeplinking (linking to a page inside a site, thereby depriving them of advertising income) is considered very bad form. While no one is churlish enough not to appreciate links, the loss in revenue can be extremely damaging.

Of course a lot of photographers sites don't have that kind of advertising and rely on seeling prints, so deep linking isn't as much of a problem; except when it reduces their ranking in search engines.
