Since I am the original owner,can I license the same photos to more than one person?

Yes, depending on how you license it to the people.

I.e., if you give them an exclusive license, then you've told them you won't license it to anyone else.

Typically I charge a lot more for an exclusive license (about 10x in some cases). More usually, you license it for limited use rights, or limited exclusivity - e.g., North America only, or print usage only and that sort of thing.

I've sold certain pictures multiple times for much increased sums because of doing this, carefully.

No exclusive rights were talked about. I made this person a good deal for $20 a photo. But I also have some one else that wants some of them.

Are these verbal agreements Gordon or do you have forms they sign?

I pretty much have it all in writing. Saves a whole lot of misunderstandings later on. Doesn't have to be over the top or lots of legalise, but just make it clear what they can & can't use it for. There are plenty of books that cover this sort of stuff.

FYI, this is the comment I put on invoices for images, will give you an idea.

As Gordon said, keep it simple, and to the point... no need to get all leagalise on us..

"Terms: Non-exclusive use for XXXXX related documentation and/or promotional materials in print media. 640 pixel wide (or less) reproduction for Web/Internet promotional purposes. This grant of copyright does not include further distribution or resale of any image(s) supplued without the express permission of Chris Hellyar."

If you haven't worked out what type of license you sold those images under then you've done both of you a disservice - that's the stuff where lawsuits come from. Here's some examples ...

1) Exclusive:- Time-controlled, for example
- 1 month $350
- 6 months $1,200
- Permanent $2,500

2) Royalty Free:- Perpetual non-restrictive but not exclusive $250

3) Traditional:- The usage rights are defined and negotiated for a specific project needs. Factors include print run, intended use, reproduction size, distribution etc

4) WWW Licence:- $40 each for one website, no expiry date.

If you don't define anything then neither you nor the client know what they are paying for. You could get sued for selling "their" image to someone else or you could be ripped off when your image becomes a 52 state billboard campaign - all for $20
