Hi all -

We have a bride who is relaying interest from friends in our coffee table book design. She is asking if we are given a cd of images would we take those and make a book from them. The opportunity at first seemed great, but then we started thinking about copyright issues. Has anyone been presented with this opportunity? Did you require any kind of release from the original photographer?

Thoughts?

I'm not sure I understand what you are asking... Is someone asking you to take their photos and make them into a coffee table book?

If so, you would need the permission of the original photographer to reproduce the work...

If they were given the CD so they could make their own prints, it's probably OK, especially if you are making a one-off album for their wedding.

Using the photos in a published book ("How To Run A Successful Wedding for $5") would probably require an additional release from the photographer.

If the original contract specified that the CD was for proofing and print ordering from the photographer, you can't use them at all.

Do make them show you documentation that they have the right to reproduce the images.

Note that unless you have a written contract with these folks stating otherwise, they will own the copyright on the final book design under the "work for hire" doctrine of US Copyright law.

You need permission from the photographer, I use to do designing for coffee table books (the whole book publishing thing) well anyway they were very strict. You have to get permissions from photographers, some will even charge for their use of the photos or their slides, etc....

Also all photographers I dealt with want their names wherever the photo is.
