i may be totally wrong, but it seems like last year it was determined that if a picture has been "published" on dpc, it is not eligible.
not sure, though. i'll try to find last year's thread. |

You have to be an amateur, meaning less then half of your income comes from photography. |

"Photographs previously published or pending publication, or photos that violate or infringe upon another person's copyright, are not eligible."
Also of note...
"By entering the contest, entrants grant Smithsonian the right to publish and use submitted photographs in print or electronic form in a future issue or issues, for advertising and promotion of the magazine, for exhibition, and for commercial products, including but not limited to Smithsonian publications. Any photograph reproduced will include a photographer credit."

Does an image being posted here count as being published?

I doubt it, but I'm not positive.

Thanks for the heads up.
Anyone know what dimensions they want? It gives a 1 MB file size limit but I don't see dimensions. Should we reduce or try to fit by compression?

what they replied:
Hello,
Thanks for writing. We do not accept photos that have been entered in
previous contests, not necessarily because of prizes won, but that we want
to ensure that entrants have exclusive rights to their photograph.
Sincerely,
SMITHSONIAN

"Posted on here" is not the same as "entered in other contests"...

you can take your chances i suppose, but it was pretty clear to me.
If it was just in a thread or port you are probably okay.
If it was in a challenge, I would proceed with caution. |

I would assume then that DPC challenge entries are fine...DPC don't own any part of challenge photos do they? These are submitted for critique purposes only on DPC. Anyway will send them a mail asap to find out.

My point is that something that just hangs out in your portfolio or that was posted in the forums for a critique has not been entered in a contest. If that's the criteria, then not everything posted on DPC is going to be ineligible.
I would also argue that publication is a condition in which some sort of rights management is involved. If I just post something in my blog, then there's no rights exchange and nothing to get worked up about, and posting in the forums is just about the same thing.

My own guess is that if you have a photo worth winning, it is worth more than $500.
Seems like a cheap way to get a lot of photos that they can then put on any calender, magazine, mug, postcard or whatever...

You win more than $500, hon. Not many people can put the Smithsonian on their resumes for a ribbon credit - it's just slightly impressive looking, even to the average joe what with the name recognition and all ;-)

This is the crux of the problem, in that none of us have "exclusive" rights to any photo posted here -- we have granted a limited perpetual license to DPC to continue to display the photos as part of its ongoing operation.
If the Smithsonian wanted an exclusive license (though it appears they don't, up front anyway), we couldn't grant it.

One thing: you can retract any image from your portfolio, but you cannot really remove any of your images from the challenges, not even if you leave DPC.
ETA: or what GeneralE just said.

Personally, I don't think it's an issue to submit an image that was on DPC. Bill Jemison one a Blue with this image and also won 1st Runner Up in the Popular Photography 2006 Annual Readers Picture Contest - I'm sure they had similar verbiage in their contest rules. They just want to make sure that there are no legal issues with ownership of your image.
