While I do see the point in giving the site time to comply. It seems to be their policy to steal images. I genuinely hope to see them shut down completely.

Irene I also hope that they close down any sites that steal from other people, that has nothing to do with photography,as for your comment
Dpc wouldn't be a "community" if we didn't try and help each other when times get tough.
I thank Cindi and Leroy from the bottom of my heart for going over there and "rattling chains".
I think you are right and if anyone is a decent dpc member they should know that one day this could happen to them and that they should all be around to give support, hope all goes well for you. |

one point of attack is that you can contact their domain and hosting provider ...
although individual sites may have no scruples about stealing images, the people who host them don't want bad publicity and be an accomplice to copyright theft.
hosting companies will shut down sites if that site doesn't comply with the host's rules and with the laws of the country (such as copyright).
find out their host and send some emails! :)

Do you sell on any micro-stock sites? If so, is it possible break.com acquired a valid license to use the photograph from one of those sites?

No, I don't sell on any micro stock sites. They just downloaded the image from my pbase site and presented it as theirs.

Even if they did, they aren't allowed to just stamp their logo on it as if it was created by them.

Then again DPReview.com stamps their logo across the fullsize images of digital cameras. The images of course being from places like nikon's press pack...... SLightly different but same logic.
Theres about a hundred sites that do this sort of crap ebaum's world does it to videos and weirdspot does it to images. |

Nah... press packs are meant to be republished... that's what they are put out for.
And stock photos can have logos added... how else would I have a condom ad? ;-)
But, none of this matters, because she didn't sell the image. they stole it.

DPReview isnt just redistributing the press pack photos... they put a logo band across the middle of the image as theyre trying to hoard th eimage for themselves. They act like its theirs to protect and like thier keeping exclusive access. I didnt say crap about redistributing. |

I'll tell you why they do it and assure you it's perfectly legal.
They do it to keep sites from hotlinking the pics and hogging up their bandwidth. At least if someone is hotlinking they do get some advertisement from it.
Now having done Journalism and PR in former careers, I assure you that companies like Nikon, Canon, etc are fully aware of DPReview's use of the photos. It's really no different from having the photo in a catalog (ie B&H, which I think also adds a logo).

Okay love ya dude but reread anything ive said... your tripping off the other argument.. i nevr said anythign about it being illegal. And btw pletny of sites use things like .htaccess or PHP scripts so when somone hotlinks their image nothing shows up but a big fat logo (theirs) that under it says "no hotlinking".
You read way too into what i was saying i was looking on the otherside. I wasnt the lagality or the right. I wasnt really trying for if it was right although i sorta touched on it a bit.

It seems the same person who used that shot of Irene's also put up the winning EXIT shot and stated it was "This is an amazing shot of Comet McNaught taken by a photographer in South Australia."

Strangely enough it was the milk with coffee shot that first brought me to DPC. Though it was linked through //del.icio.us to the original image on DPC. After my first dismal offering I'm not sure I'll be thanking IreneM for bringing me here just yet :)
I understand why the use of copyright logos is not allowed as you would be able to identify the photographer. Perhaps the supreme council could consider the use of a standard DPC logo to mark copyright for the photographer, inserted before entry. It will not stop all (I have seen the photoshop skills here), but certainly discourage many...
Its probably been discussed before but this seems a appropriate place for it. |
