It is not my best photo but is is my first known illegal use... Does that mean I have arrived?

| It is one posted of my photos posted here on DPC that is being used on someones scrap booking blog site with out permission. |

Whether they give credit or not is irrelevant. Its illegal use if she did not get permission from the photographer via verbal agreement or contract. Now does one bother to pursue the matter over a blogsite? That's up to each copyright holder.

I wasn't suggesting that it was legal, just that she was not trying to pass it off as her own work. |

I sent her an email letting her know she needed to get permission, I really am not looking for anything other than her asking to use it and posting photographer credit below the photo. It's more the issue of people thinking they can just use it because it is on the web. |

It's a hot linked image with barely any traffic, nothing to get your panties in a bunch.
Highly immature to go spamming her poor blog with "PHOTO THIEF" messages; that's actually illegal too (harassment/slander).
A polite but to the point e-mail would be much better and more direct.
Rude and illegal, but honestly calm down. Go to your lawyer, explain the issue, take her to small claims court, get her to pay up, bada bing...chances are it won't be worth it.

I would definitely have a problem with someone stealing my photo (but secretly, I would be saying "Yes!"). |

I believe PapaBob was quite lighthearted about this, Karl. In fact, it is your response that seems a bit over-the-top... imo. |

It would be libel instead of slander, and I don't believe a post to her blog of this type would be illegal in any way. Immature... maybe... Illegal... not quite.

All I did was send her an email, I did not put anything on her Blog, I even gave her permission as long as she would put credit under the photo. I think you need your panties pulled back a little....lol |

| I've had a couple of my images on Flickr used by blogs, but I had them uploaded with a creative commons license and they gave me credit and a link. |

My god...I read the blog with the Photo Thief entry!!! Who the hell did that? Someone from DPC I assume.
You should take that off the blog and let PapaBob handle it how he wants.

I couldn't agree more. Why scare the poor woman off? Just politely say hello and ask if she'd mind giving you a photo credit before stampeding for the pitchforks and torches. |

I am not sure who wrote the blog entry, I was tipped off about the use of the photo from someone whose name did not come up when I searched DPC, it could have been that person. Hopefully it was not someone from DPC but if it was I hope they have it removed and in the future others will practice restraint and let the photographer handle it. Thanks everyone.

Im a little supprised at some reactions. If your able to google search the images on DPC, what makes us think that the regular joe/jane would realize that an image on google would be copyrighted?
Frankly, as this is a photography website, I dont see why we dont just disable right clicking in the html. I know it means pouring over code and old pages, etc etc. But as a good portion of us pay for the service should we be at least a little protected?
I just dont think we can get angry at folks for not knowing an image that appears in a google search isnt ok to use. Or is the thought is that ALL images are owned and permission should always be sought?
PapaBob, I think you did the right thing and saved a bunch of panties in the process. Cheers. |
