Ok guys, here's another go at this--the proper way. If you are a photographer who previously granted permission, you will be recieving an IM with waiver as well.

To Participate:

Submit your favorite photograph--ribbons prefered! However, some of our favorites are not blue, red or yellow, so post your non-ribbon favorites here as well.
Not all images submitted will be used, as I cannot guarantee permission from all of the photographers nominated. But please don't hesitate to share your favorites here.

Terms and Conditions
for the publication formerly known as The Best of The Best of DPC
New title to be announced.

1. This book will be a 26+ page 8.5 x 11.5 Horizontal Photo Journal, and published through Heritage Makers using the following materials:

whiteness 106 CIE- gloss, silk and matte

2. No images will be used without written permission from the photographer. (See Heritage Makers Terms and Conditions) //www.heritagemakers.com/terms1.cfm

3. Images will be accompanied by photographers name, and additional information that the photographer may choose to include such as: location, contact information, website, editing details, or not, as is the photographers discretion. Photographers will be listed in the back of the book with (contact info if included).

4. This book will created in my Heritage Makers consultant account. The normal price for the book is $69.95 plus tax and shipping. The price of this book will be $56.00 (flat cost) plus taxes and actual shipping. Shipping will be US Priority Mail, and actual shipping costs will be provided shortly. Will ship outside of the US. I will not profit from the creation of, nor the sale of this book.

5. The images used in this book are the sole property of the photographer, and will be used only in the production of this book. The images will not be used for any other purpose, professional, commercial or otherwise, and will not be sold, traded, or made viewable to any other person except in the form of the finished product. Images will be deleted from Heritage Makers upon completetion of this project. No images will be used to promote Heritage Makers or any of it's products.

6. My own copy will be for personal use only, and will not be used as a sample to promote Heritage Makers or any other business by way of expos, private consultations, classes demonstrations; in home or public.

7. This book will not be commercially available. This book will be available only to DPChallenge members. This book will not be solicited to the participating photographers, or to DPChallenge members.

8. This project is being not produced by, nor is it endorsed by DPChallenge or Heritage Makers. This is an independent project being put together by private individuals.

9. The DPChallenge name logo, or DPC acronym will not be used in the book in any way.

I will be away from the computer until 8-22, but will be able to check sporadically until then. I will do my best to answer your inquiries during this time.

Thanks for all the feedback and direction from the other thread. I hope this covers all the bases and that DPCers can feel comfortable participating, as this project is a tribute to all the the talent here at DPC.

cool, I'll sumbit some tonight when I have time. I would call it
"The Best of DPChallenge: 2002-2007" in case there's another book in the future.
Hmm, I was wondering, I think my camera only does 180 dpi resolution? Am I wrong because if not I'm sure a lot of people won't have high enogh resolution photos?

You missed the part where it says:

9. The DPChallenge name logo, or DPC acronym will not be used in the book in any way.

So I doubt DPC will be mentioned in it at all.

DPI is Dots PER Inch it is entirely irrelevant until you go to print the image. The only thing which matters is the total number of pixels available.

A picture which is 1200 pixels wide will print 4" wide at 300 dpi, or 12" wide at 100 dpi, or 10" wide at 120 dpi, or 1" wide at 1200 dpi ...

Maybe it would be clearer if it was written "180 dots/inch" ...

It is not sponsored by or officially affiliated with DPC, but under some specific conditions (see the original post) we decided DPC can be used to help organize it.

They should change the name to "A TALE OF TWO CITIES" or "ARE YOU THERE GOD, ITS ME MARGARET" and I bet they would sell really well.

Site Council has decided to lock this thread, and place forum discussion of this project "on hold".

Historically, we have allowed latitude for established participants to advertise charitable events and photography-related products on the forums. Likewise, we have a great deal of respect for photographers' ownership of their photographs, and their rights to license them (or not) as they see fit.

We continue to stand behind those philosophies, but feel that in order for these philosophies to be effective, there needs to be a level of transparency sufficient to allow all stakeholders to make a fully informed decision whether to participate. For similar past projects, this need for transparency has not been an issue. In this case, however, we believe that some vital information has not been freely released.

This message and thread-locking should not be taken as a statement as to whether this is, or is not, a worthwhile project in which to participate. We believe that is a decision to be made individually be each potential participant for himself or herself. We offer no opinion as to whether anyone should release their photographs for this purpose, nor to whether anyone should purchase the book. This lock should not be taken as a condemnation of the project itself, nor should an eventual decision to allow it to continue be considered an endorsement.

That said, we do expressly reserve the right to disallow the use of DPChallenge to further this project at any time, for any reason. Most likely, we would do this only if it became evident that participants were not being provided fair and accurate information.

I've been asked to allow one of my images to be published in this book. I have to decline on a number of grounds:

1. Once published in this way the image may be ineligible for further use in competition or may reduce the commercial saleability of the image at a future date.

2. The image is already published elsewhere and further publication may infringe the publication rights.

3. The Heritage Makers outfit is a North American organisation and doesn't appear to make its books available world wide, I only see shipping to US on the website. I'm based in the UK.

4. I haven't seen any evidence or discussion about the copyright terms, usage terms or any other 'publication rights' normally associated with a publication of a photograph. This worries me A LOT! (emphasis added by me).

So unfortunately none of my images will be appearing in this publication. Sorry, but thank you for the nomination.

Well, since a member of the SC has posted in this thread and is trying to help explain things, I am going to ASSUME that they have worked it out so the project will be legit and fair to all associated with it.

I read the other thread in its entirity and I believe there have been some PM's exchanged or something worked out so this can be done legally and right.

Correct me if I am wrong, but I think the SC would have locked this thread immediatly had they not known it was coming and what would be in it.

Just my $0.02 :)

' chinpaca has very willingly worked with the SC and agreed to a list of terms we felt were necessary in order to permit this project to continue on DPC. SC and DPC are in no way endorsing this project but are satisfied with the terms that chinpaca has agreed to.

Hey guys,

To adress Falc's post:
3. At this time, Heritage Makers does not yet ship outside the US and Canada, but are looking forward to doing so in the future (hopefull by early 2008). The reason is because at this point we have not found a shipping partner that would allow for affordable shipping rates. As it stands, our first overseas ventures will be in the UK and Australia. I will ship to the UK, and will get the lowest price I can, if anyone else is interested.
4. Regarding copyright terms, I am very open to adding to the Terms and Conditions of this project if it would better serve the parties involved.

The reason I put the price at cost versus donating the proceeds is this: For lack of a better way to say it, I felt that it would get too sticky. I don't want to open any doors for I am very much in support of donating money, time, services. But in this case, I would rather offer at cost since no charity had been chosen, and I didn't believe that there would have been a substantial contribution to make. We all have our causes, and can donate our time, experience and talents for their betterment. I believe that would go farther than the few dollars that might have come from it. I realize that money is vital, and that every cause needs it :). I also did not want to open the door to accusations of mis-use of funds, or anything related to that.

With that being said, if the participants would really rather have this be a fundraiser, then lets do it! Here's how the money would work.(I will add something more legal-eze if it goes to that point).Commission gets deposited into my business account on the 10th or closest business day. I would provide a record of the amount raised to SC, and then....pictures of the check being delivered? If you all really want this, then let's really do it, but it will not be worth the investment of my time if it's only 3 or 4 people who really want a book. If that's the case, and that's ok with me if that's the case! But if that's the case, let's just each of us donate 14.00 to our favorite charity and keep it at cost.

My vote would be for Operationstory.org NFP with 100% of donations going to the charity.

What do you think guys?

Personally if I was to purchase a best of DPC book I would prefer to purchase a book endorsed by DPC and to carry the DPC logo.

Sorry but anything else seems to be second rate to me.

This is just my individual opinion and is in no way an attempt to influence any other members.

I wish you luck with your project.

No cover as yet--I haven't even thought about it with everything else. I'm still trying to figure out what we'll call it--the DangPurtyChupacabra winners....just kidding SC!

Of eligible photo's submitted, maybe the one that has the most nominations....

Ya know, you could do this as a yearly thing for DPC. Put some (or all if theyd fit) in a hardback book and sell it through this site. So you could have 'best of 2006', 'best of 2007' etc etc.

Like a yearbook for DPC, and maybe some bios for special entrants, like Scalvert and his 600 ribbons...
