You can sell it for editorial use, you can't make money from other uses unless you have a signed consent form.

I was under the impression that if you are taking a photo in a public place that you could legally sell it. Is this not true?

Is he aware this is for sale? If his management haven't given consent, you could get yourself into trouble.
