This is a tricky shot because you have the fence that seems to be the horizon yet the trees (perpendicular to the REAL horizon) are straight up and down.

Good shot! One Very minor criticism: the horizon is not quite "perfect" and it's just a little annoying. Great scenery and sun rays, though!

I think the shots a little dark and the white...snow I assume?...is a distracting, but on the plus side, "Waldo" is well hidden considering how out in the open the person is.

This is a really neat setup. I've had shots like this where I decided to go black and white, but in this case, I'm not sure you didn't choose the better option. The blue of the hat provides a subtle amount of complimentary color that I like...unfortunately, it also helps to give "Waldo" away, but that's "Waldo's" loss, huh?
