Some may argue black is not a color but the lack there of. I believe that if you can buy a black dress, construction paper, or anything else black, that uses dies to get there, then it must be a color. Besides if you look closely, the pigment of this bird is not entirely black.
The following are my editing steps.

Recovery 37
Fill light 15
Blacks -0-
Brightness +50
Contrast +59
Vibrance +64
Saturation +35
Open in CS3
Bump Saturation in blue channel.
Burn tool on branch and clouds
Crop
Sharpen twice noise ninja
Resize
Bump contrast
Save for the web.

Black happens to be my favorite color, so I'm guessing I think it's one. Love the title, by the way.
